Article 1 - The general terms and conditions

1.1 These general terms and conditions apply to every offer made by Moontopup and to every agreement concluded between Moontopup and the consumer.

1.2 Should any provision of these general terms and conditions be null and void or be annulled, the other provisions of these general terms and conditions shall remain in full force and effect.

Article 2 - The purchase agreement

2.1 The offer contains a complete and accurate description of the digital products offered. Obvious mistakes or obvious errors in the offer do not bind Moontopup.

2.2 Moontopup is not a publisher or issuer of digital products. The offer is at all times limited to what is offered or made known by the publisher or issuer of the digital product in the product conditions of the digital product.

2.3 The purchase agreement is concluded when the consumer activates the 'Safe order' button. The purchase agreement comes into effect on condition that the consumer's payment has been received by Moontopup.

2.4 Use of credit cards: when a purchase is made with a credit card, the consumer confirms that the purchase is made exclusively for personal use and not for third-party interests. This condition is intended to ensure compliance with credit card non-transferability requirements.

2.5 Upon receipt of payment, the digital product will be delivered immediately.

Article 3 - Exclusion of the right of withdrawal

3.1 Digital products
The moment you click on "pay" you agree to the direct execution of your order by moontopup.com. This cancels your right of withdrawal because digital codes can be used immediately.

3.2 Physical products
Products to which the statutory 14-day cooling-off period for consumers applies are, in our case, only the SIM cards we sell on moontopup.com. You can contact us online via chat or customer service [email protected]. You must notify us within 14 days of receiving the product that you wish to withdraw. We will refund all charges within 14 days of receiving the product from you.

Please note that SIM cards can only be returned unopened and the additional return costs are for the buyer.

Article 4 - The price

4.1 The price of the digital product is the price indicated in the shopping cart of Moontopup's webshop.

4.2 The price on the payment page may specify VAT, transaction costs and service costs. Transaction costs are the costs charged by the payment service provider to Moontopup for the use of the payment method chosen by the consumer, such as the fee charged by the payment service provider for the transaction and a surcharge for the periodic fixed costs charged by the payment service provider. These transaction fees vary by payment method and are shown on the payment page if applicable. Service fees include all other costs that Moontopup charges for its services. These may vary per product and are shown per product in the shopping cart if applicable.

4.3 Notwithstanding 4.1, Moontopup may offer digital products whose prices are subject to fluctuations in the financial market and over which Moontopup has no influence, with variable prices. This connection to fluctuations and the fact that any prices stated are target prices shall be stated with the offer.

Article 5 - Delivery and execution

5.1 Delivery is made by email or SMS. The consumer must provide the correct email address and verify it properly. If the consumer has provided an incorrect email address, the digital product cannot be delivered again. The consequences of providing an incorrect email address are therefore entirely at the consumer's expense and risk.

5.2 Customers paying by PayPal will have the product delivered to the PayPal email address. Moontopup is not liable for not having access to the PayPal email address to which the product is delivered.

5.3 Consumers must enter the correct region and verify it properly. Changing the region is no longer possible once the 'Safe Order' button has been activated. The consequences of entering an incorrect region are therefore entirely at the consumer's expense and risk. Delivered digital products cannot be returned.

5.4 In the event of a defect, the consumer is obliged to cooperate with Moontopup so that Moontopup can ascertain the cause of the defect. The consumer is obliged to provide Moontopup with all relevant information, such as a screenshot of the error message, the account value, currency and region of the account where the credit was to be added and the website URL of the redemption page. The consumer is obliged to provide Moontopup with digital access to his device to identify the cause of the defect.

Article 6 - Fraud

6.1 Moontopup is constantly confronted with (legal) persons wishing to commit fraud, money laundering, financing terrorism or using Moontopup's services in any other unlawful or improper manner. The interests and integrity of Moontopup and others may be damaged as a result.

In cases of fraud, we cannot issue refunds after the order has been shipped. However, we can block the fraudster to prevent recurrence. If the order has not yet been shipped, we have the option to stop it.

Our employees operate strictly from our customer service and are not active on other platforms such as Marktplaats, Wativo or similar channels.

We always recommend reporting to the police or the appropriate authorities and/or taking independent measures against fraud, money laundering or terrorist financing.

6.2 To prevent fraud, our automated payment system may temporarily hold your order for verification, especially for higher amounts. This process is fully automatic.

6.3 If fraud is suspected, Moontopup may have all data provided by the consumer verified by the Bureau Kredietregistratie (BKR), the Bureau Economische Datas (BED) or other authorities. The consumer will be informed of this check.

Article 7 - Guarantee

7.1 Moontopup warrants that the digital products comply with the agreement, the specifications mentioned in the offer, with the reasonable requirements of soundness and/or usability and the existing legal provisions and/or government regulations on the date of the conclusion of the agreement.

7.2 It is possible that the product conditions applicable to the digital product have not been made available to Moontopup and/or cannot be made available by Moontopup. The consumer is then obliged to download them himself from the website of the publisher or issuer of the digital product.

Article 8 - Force majeure

8.1 Moontopup shall not be obliged to fulfil any obligation vis-à-vis the consumer if he is prevented from doing so as a result of a circumstance which is not due to his fault, and for which he cannot be held accountable by virtue of the law, a juristic act or generally accepted views. In these general terms and conditions, force majeure shall be understood, in addition to what is understood in this respect in the law and case law, to mean all external causes, foreseen or unforeseen, over which Moontopup cannot exercise any influence, but which prevent Moontopup from fulfilling its obligations, including internet malfunctions, malfunctions in the payment service, lack of stock, war, riots, fire, strikes, transport difficulties, lack of energy, disasters, restrictive government measures, defective functioning of business installations, default of third parties in the supply or provision of products or services.

8.2 Moontopup is entitled to suspend its obligations during the period of force majeure.

8.3 After having been informed of non-delivery on account of force majeure, the Consumer shall be entitled to cancel the contract.

Article 9 - Liability

9.1 Moontopup is not liable for damage in the event of fraud, money laundering or financing of terrorism or any other unlawful act or suspicion thereof.

9.2 Moontopup is not liable for damage resulting from loss, theft, destruction, abuse or improper use of a digital product.

9.3 Moontopup is not liable for damage if the term of a digital product has ended.

9.4 Moontopup is not liable for damages due to restrictions or limitations in product conditions of the publisher or issuer of the digital product. Moontopup is also not liable for damages resulting from acts, omissions or decisions of a publisher or issuer of the digital product. Moontopup is not liable for damages if product terms of the digital product have been violated.

9.5 Moontopup is not liable for damages in the event that the information obligation of article 5.3 is not fulfilled.

9.6 Moontopup is not liable for damages resulting from (account) hacking, social engineering or other unlawful acts of third parties.

9.7 Moontopup is not liable for any damage resulting from an incorrect entry of the e-mail address, an incorrect choice of country or other incorrect entry or choice by or from the consumer.

9.8 Moontopup is not liable for damages resulting from an act or omission by third parties.

9.9 Moontopup is not liable for damages if the issuer of the product or the operator of the website where the product is redeemed has detected (a suspicion of) fraud, money laundering or terrorist financing.

9.10 Moontopup is not liable if the product cannot be used due to a malfunction at the publisher of the product or at the operator of the website where the consumer wants to use the product.

9.11 Moontopup is not liable for costs charged by the issuer of the product, such as maintenance fees or redemption fees.

Article 10 - Complaints procedure

10.1 Moontopup has a complaints procedure published on its website and handles complaints in accordance with this complaints procedure.

10.2 Complaints about the performance of the agreement must be submitted to Moontopup fully and clearly described.

10.3 Complaints submitted to Moontopup shall be answered as soon as possible, but at the latest within a period of 14 days calculated from the date of receipt. If a complaint requires a foreseeably longer processing time, Moontopup will notify the consumer within the 14-day period when the consumer can expect a more detailed answer. Moontopup will make every effort to find a satisfactory solution.

Article 11 - MoonCoins

11.1 Depending on the product purchased and its currency, the consumer saves an amount of Moontopup Coins determined by Moontopup. Moontopup Coins can be redeemed when buying some digital products determined by Moontopup on the Mooncoins page.

11.2 Redemption is made by selecting a digital product and activating the Redemption button on the MoonCoins page. A redemption cannot be undone, even if the wrong digital product or region is unintentionally selected. Moontopup Coins are never redeemable for cash.

11.3 Moontopup Coins cannot be transferred. Allocation of Moontopup Coins is linked to the consumer's e-mail address.
